Welcome to Life Changing Care. By entering into a Service Agreement and using our services, you agree to comply with the following Terms of Service (“Terms”). Please read these terms carefully, as they govern your use of our services. If you have any questions, please contact us.
1. Agreement to Provide Services
By agreeing to these Terms, you (the “Client”) confirm your understanding that Life Changing Care will provide the services as outlined in your Service Agreement. These Terms, alongside the Service Agreement, are binding on both the Client and Life Changing Care and govern all services provided.
2. Modification of Terms
Life Changing Care reserves the right to update or amend these Terms at any time. You will be notified of any significant changes, and your continued use of our services after such changes constitutes acceptance of the new Terms.
3. Service Delivery
3.1 Life Changing Care agrees to provide services professionally, in line with accepted home care standards in Australia.
3.2 Services will be provided at the Client’s designated location, except where transportation services are involved.
3.3 Any changes to the agreed services must be communicated and agreed upon in writing before the next scheduled visit.
3.4 We will strive to assign a caregiver who is well-suited to the Client’s specific needs.
3.5 While we aim for punctuality, unforeseen circumstances may occasionally cause delays.
3.6 Our services are non-medical unless explicitly provided by a Registered Nurse, who may offer limited medical services such as medication administration and wound care.
4. Transportation Services
4.1 Transportation may be provided using public taxis, licensed vehicles, or the caregiver’s personal vehicle.
4.2 Clients are responsible for any transportation-related costs, such as taxi fares or per-kilometer charges for the use of the caregiver’s vehicle.
5. Privacy and Confidentiality
Life Changing Care is committed to protecting your privacy and handling your personal information in accordance with the Privacy Act. We ensure that all personal information is kept confidential and secure.
6. Client Responsibilities
6.1 Clients must inform Life Changing Care of any relevant medical, psychological, or other issues that may impact service delivery.
6.2 Clients are responsible for providing a safe and hazard-free environment for caregivers.
6.3 Clients must treat caregivers with respect, avoiding any form of verbal or physical abuse.
6.4 Clients agree not to engage caregivers for private employment within 12 months following the conclusion of the service agreement. Violation of this clause may result in a placement fee.
7. Payment Terms
7.1 Clients are required to have a valid payment arrangement in place before services are delivered.
7.2 Life Changing Care reserves the right to suspend or terminate services if payment terms are not met.
7.3 Payments are due according to the rates set out in the Service Agreement, which may be amended at Life Changing Care’s discretion.
7.4 Payment can be made by direct deposit or credit card.
7.5 Invoices are issued weekly, and payment is due within 7 days of the invoice date.
7.6 A valid credit card may be required for authorization purposes, particularly in cases of non-payment.
7.7 Late payments may incur a fee of $20 or 10% interest on overdue amounts.
8. Cancellation Policy
8.1 Service cancellations must be communicated in writing at least 24 hours before the scheduled visit.
8.2 Failure to provide sufficient notice for cancellations may result in a charge for the scheduled service.
8.3 If Life Changing Care is unable to provide a caregiver for a scheduled visit, no charge will apply.
9. Incident Reporting
9.1 Any accidents, damage, or theft involving caregivers must be reported to Life Changing Care in writing within 24 hours of the incident.
9.2 Clients must complete an incident report within 5 days of notification for any claims related to such events.
10. Limitation of Liability
Life Changing Care will not be held liable for any losses, damages, or costs incurred as a result of services provided, except in cases of gross negligence or as prohibited by law.
